Regulatory Changes May Boost Cosmetics Liability Claims

Steve Napolitano published an article in Law360 discussing potential legislation that could significantly change how cosmetic products are regulated by the U.S. Food and Drug Administration.  If legislative reform is enacted by the 115th Congress in this area, manufacturers are likely to see an increase in product liability claims regarding such products.  In that reform of the rules governing cosmetics has garnered both industry and bipartisan support, it is possible that changes may be enacted in this area despite the Trump Administration’s stated goal of broadly reducing federal regulation on businesses.
