Known Unknowns: The Uncertain State of Religious Discrimination Claims in the Wake of EEOC v. Abercrombie & Fitch

Tammy Yuen and Jonathan Sorkowitz, with Jane Lee from Arch Insurance Group, co-authored an article about the uncertainties facing employers wishing to avoid discrimination claims based on religious practices following the Supreme Court's decision in EEOC v Abercrombie & Fitch. The Abercrombie majority reserved decision on whether an employer may be liable for discrimination if it does not even suspect that a practice is religious in nature. The article discusses the potential consequences this holding has for all employers and what employers can do to avoid claims like those asserted in the Abercrombie suit.
